This updated Terms of Use incorporates all required Paid Services clauses, aligns with the Payment & Subscription Policy, and ensures legal consistency across Animaat's services.

1. Introduction

Welcome to Animaat.

Animaat LLC (“Animaat”, “the Platform”, “we”, “our”, “us”) provides technologies and services designed to help animal lovers connect, build communities, and grow businesses. These Terms of Service (“Terms”) govern your use of Animaat and all related products, features, apps, services, technologies, and software (collectively, the “Services”), except where we expressly state that separate terms apply.

By accessing, browsing, or using our Services in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not access or use the Platform.

2. Our Commitment to You:

Animaat offers its core community and connection Services for private, non-commercial use, unless otherwise stated. We do not charge you for using Animaat’s core features. Paid Services (such as Verification and Badges) are optional enhancements subject to the separate, binding Paid Services Terms & Payment Policy.

We prioritize your privacy. We do not sell your personal data to advertisers. We do not share information that directly identifies you (e.g., name, email, phone number) with advertisers without your explicit permission.

3. Your Privacy:

Our Privacy Policy outlines how we collect, use, store, share, and protect your personal data. It also details your rights regarding your information. You may review and adjust your privacy settings at any time within your account. By using our Services, you consent to the data practices described in our Privacy Policy.

4. Your Agreement with Us

These Terms form a legally binding contract between you (the “User”) and Animaat LLC. By using our Services, you agree to comply with these Terms and all incorporated policies, including our:

5. Your Animaat Account

5.1 To access most features of our Services, you must create an account and provide accurate, complete, and current information. You must promptly update your account details to ensure they remain accurate.

5.2 You are solely responsible for safeguarding your password and for all activities that occur under your account. Do not share your login credentials or transfer your account to another person without our prior written permission.

5.3 You acknowledge that content you post may be publicly accessible depending on your privacy settings. Public content may be viewed, shared, re-shared, or indexed by third-party services, including search engines.

Pet Profile Co‑Guardianship

If you choose to share guardianship of a pet profile with other users:

  • A synchronized copy of the profile is created in their account.
  • Updates made by any guardian are reflected across all linked profiles.
  • Removing a guardian severs future synchronization, but historical data shared up to that point remains in the other guardian’s account.

By accepting these Terms, you expressly consent to this data-sharing functionality and release Animaat from liability arising from shared profile management.

6. Your Commitment to Us

To maintain a safe, positive, and lawful community, you covenant and agree to the following:

6.1 Eligibility Requirements
You represent and warrant that you:

  • Are at least 13 years old (or the minimum legal age of digital consent in your country).
  • Are not legally prohibited from using our Services under any applicable law, regulation, or sanction list.
  • Have not had a previous Animaat account disabled for violations of these Terms.
  • Are not a convicted sex offender.
  • Are not a convicted animal abuser or a known participant in organized animal cruelty (e.g., dogfighting, cockfighting, illegal breeding operations).

6.2 Content & Behavior Requirements
You must not, and must not permit others to, use the Platform to:

  • Promote, glorify, or participate in animal cruelty, abuse, neglect, mass poisoning campaigns, ritual killings, or any entertainment-based harm to animals.
  • Share content that is unlawful, libelous, discriminatory, fraudulent, deliberately misleading, or that incites violence.
  • Share content that infringes upon or violates the intellectual property rights, privacy rights, publicity rights, or contractual rights of any third party.
  • Upload viruses, malware, Trojan horses, or engage in spam, flooding, or other disruptive behavior.
  • Access Animaat via unauthorized automated means (bots, scrapers) or attempt to circumvent any access restrictions.
  • Collect, harvest, or misuse personal data of other users without their explicit consent.
  • Misuse our reporting, appeals, or dispute resolution channels by making false or frivolous claims.
  • Use the Platform or any Paid Service to facilitate any transaction or activity that violates the acceptable use policies of our third-party payment processor (Paymob) or associated financial networks, including but not limited to transactions involving gambling, adult content, illegal substances, or politically motivated funding.
  • Initiate a bank chargeback or payment dispute for a Paid Service without first engaging in the mandatory direct resolution procedure outlined in Section 12.7.

 

6.3 Enforcement Actions

We reserve the right, but assume no obligation, to investigate and take appropriate action in response to violations. This may include, without limitation:

  • Removing or restricting access to content.
  • Suspending or terminating your account and access to Services.
  • Revoking Paid Services and associated benefits without refund.
  • Taking legal action.

Where reasonably possible, we will provide notice of such actions unless:

  • There are repeated or severe violations,
  • Providing notice would risk harm to other users or the platform,
  • Notice is prohibited by law or legal process.

7. Permissions We Request From You

7.1 License to Use Your Content

You retain ownership of the intellectual property rights in the content you create and share (“Your Content”). To operate, improve, and promote our Services globally, you grant us a non-exclusive, worldwide, royalty-free, transferable, sub-licensable license to host, use, distribute, modify, copy, publicly perform or display, translate, and create derivative works of Your Content. This license is for the limited purpose of operating the Platform.

This license terminates when you delete Your Content from our systems, except: (a) to the extent you shared it with others and they have not deleted it; (b) for reasonable time needed to remove it from backups and other systems; and (c) where retention is necessary for legal compliance, dispute resolution, or enforcement of these Terms.

7.2 Use of Your Name, Likeness, and Profile

You permit us to use your name, profile photo, and information about transactions and interactions you have made within the Platform (e.g., “John D. verified their business”) in connection with commercial, sponsored, or related content.

7.3 Software Updates

You authorize us to download and install updates to the software providing our Services, automatically where possible, to ensure performance, security, and compatibility.

8. Restrictions on Using Our Intellectual Property

All Animaat trademarks, logos, service marks, trade names, copyrights, patents, designs, images, sounds, software, and branding (“Animaat IP”) are the exclusive property of Animaat LLC or its licensors. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Services. You may not copy, modify, create derivative works, reverse engineer, decompile, disassemble, or otherwise attempt to extract source code from our Services, or use Animaat IP for any commercial purpose without our express prior written consent.

9. Our Services

9.1 We aim to build a global, positive community for animal lovers, connecting individuals, businesses, and organizations with tools that prioritize animal welfare and environmental responsibility.

9.2 We offer a suite of features including:

  • Community engagement tools (posts, moments, snips).
  • Detailed pet profiles and health tracking.
  • Specialized tools for NGOs, shelters, and educational organizations.
  • Business visibility and marketing solutions.
  • Verified accounts and trust badges to enhance credibility.
  • A community environment with zero tolerance for abuse, cruelty, or hate.

9.3 We continuously strive to improve, update, and secure the Platform to better serve our community. The Services are provided “as is” and “as available.”

10. Updates to These Terms

We may modify these Terms from time to time to reflect changes in our Services, for legal or regulatory reasons, for security purposes, or to ensure alignment with our payment processor’s requirements. We will provide notice of material changes via email or in-app notification at least thirty (30) days before they take effect, where feasible. Non-material changes or those required for legal compliance may take effect immediately upon posting.

Your continued use of the Platform after the effective date of the revised Terms constitutes your acceptance of the new terms. If you do not agree to the updated Terms, you must stop using the Services and terminate your account.

11. Account Termination or Suspension

  1. 11.1 We may suspend or permanently terminate your account, access to Services, and any Paid Services, at our sole discretion, if we determine that:

    • You have breached these Terms or incorporated policies.
    • You pose a risk to the platform, other users, or us.
    • Your use is unlawful or violates third-party rights.
    • It is required to comply with a legal obligation or regulatory order.
    • You have initiated an unjustified chargeback in violation of Section 12.7.

    11.2 Upon termination, all licenses and rights granted to you will cease immediately. You may contact us at contact@animaat.com if you believe your account was disabled in error.

    Liability Limits

    TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ANIMAAT, ITS AFFILIATES, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

    • YOUR ACCESS TO, USE OF, OR INABILITY TO ACCESS OR USE THE SERVICES.
    • ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES.
    • UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.
    • EVENTS BEYOND OUR REASONABLE CONTROL (FORCE MAJEURE).
    • THE SUSPENSION, TERMINATION, OR REMOVAL OF ANY CONTENT OR YOUR ACCOUNT.

    OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF ONE HUNDRED UNITED STATES DOLLARS (USD $100) OR THE AMOUNT YOU HAVE PAID TO ANIMAAT IN THE PAST TWELVE MONTHS.

This section legally integrates and reinforces the Paid Services Terms & Payment Policy. By subscribing, you affirm you have read, understood, and agreed to it in full.

12.1 Definition & Authorization. “Paid Services” include Verification subscriptions, Badge subscriptions, and any other premium offerings. By subscribing, you authorize automatic recurring payments and explicitly agree to the No-Refund Policy detailed in Section 12.5 and the standalone Payment Policy.

12.2 Payments & Currency. All payments are processed exclusively in Egyptian Pounds (EGP) via our contracted Payment Processor, Paymob. Foreign currency amounts shown are estimates for convenience only. You bear sole responsibility for all currency conversion fees, foreign transaction charges, or other costs levied by your financial institution.

12.3 Region-Based Pricing. Pricing varies by geographic region. While you may browse indicative prices for other regions:

  • Current Phase: Billing is based strictly on the region you select at checkout.
  • Future Phase: Billing may be automatically adjusted to align with your verified business country.

We may reject any Paid Service request where submitted documents contradict the selected region, without obligation to refund.

12.4 Subscription Billing. Paid Services operate on a continuous monthly auto-renewal model until you actively cancel. By subscribing, you pre-authorize Animaat (via Paymob) to charge your payment method at each cycle’s start.

12.5 No Refunds – Fundamental Term. ALL PAYMENTS FOR PAID SERVICES ARE FINAL AND NON-REFUNDABLE. This is a fundamental and non-negotiable condition of sale. This policy applies universally, including but not limited to cases of: user error, incorrect region selection, document rejection, partial use, dissatisfaction, account suspension for violation, and auto-renewal charges. Refunds are only considered if explicitly mandated by non-waivable applicable law, and remain at Animaat’s sole discretion.

12.6 Document Requirements & Validation. You must submit accurate, authentic, and current documents for verification. Providing false, inconsistent, or misleading information is a material breach of these Terms and will result in application rejection, forfeiture of subscription fees, and potential account action.

12.7 Chargebacks & Disputes – Material Breach. You must first contact Animaat Support to attempt resolution before initiating any chargeback or bank dispute. Filing a chargeback for a transaction governed by the No-Refund Policy constitutes a material breach of contract. Consequences are severe and immediate, including: permanent account termination, removal of all Paid Service benefits, a lifetime ban from future Paid Services, and our pursuit of all remedies to recover the amount plus fees, costs, and damages.

12.8 Data Retention for Compliance. To comply with our Payment Processor agreement and financial regulations, we retain transaction and application records for a mandatory minimum period (currently 18 months).

12.9 Policy Integration. The Paid Services Terms & Payment Policy is incorporated herein by reference and forms a material part of these Terms. In the event of any inconsistency between these Terms and the Payment Policy concerning payment-specific matters, the Payment Policy shall prevail.

13. Our Agreement and Disputes

  • 13.1 Governing Documents. These Terms, together with the Privacy Policy, Community Guidelines, Brand Guidelines, Copyright Policy, Music Guidelines, and Paid Services Terms & Payment Policy, constitute the entire and exclusive agreement between you and Animaat regarding the Services.

    13.2 Governing Law & Arbitration.

    • Governing Law: These Terms and any disputes arising from them shall be governed by and construed in accordance with the laws of the Arab Republic of Egypt, without regard to its conflict of law principles.
    • Mandatory Arbitration: Any dispute, controversy, or claim arising out of or relating to these Terms, their breach, termination, or validity, shall be finally settled by arbitration administered by the Cairo Regional Center for International Commercial Arbitration (CRCICA) under its rules in force at the time of filing. The seat of arbitration shall be Cairo, Egypt. The language of the arbitration shall be English. The arbitral award shall be final and binding on both parties.

    13.3 Legal Action for Specific Breaches. Notwithstanding the arbitration agreement, Animaat reserves the right to seek injunctive relief or other equitable remedies, or to initiate legal proceedings in courts of competent jurisdiction in your country of residence or elsewhere, to: (i) protect its intellectual property rights; (ii) stop unauthorized use or interference with the Services; or (iii) enforce its rights under the No-Refund Policy, including recovering funds from unjustified chargebacks.

14. Additional Terms

  • 14.1 Entire Agreement. These Terms of Use, together with all incorporated policies, constitute the entire and exclusive understanding and agreement between you and Animaat LLC regarding your use of the Platform and Services, superseding all prior oral or written agreements on the subject matter.

    14.2 Severability. If any provision of these Terms is held to be invalid, illegal, or unenforceable by a competent authority, that provision will be enforced to the maximum extent permissible, or, if incapable of such enforcement, deemed severed. The validity, legality, and enforceability of the remaining provisions will not in any way be affected or impaired.

    14.3 No Waiver. The failure of Animaat to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of Animaat.

    14.4 No Assignment by You. You may not assign, transfer, or delegate any of your rights or obligations under these Terms, in whole or in part, by operation of law or otherwise, without our prior written consent. Any attempted assignment without such consent will be null and void.

    14.5 Assignment by Animaat. We may freely assign, transfer, or delegate our rights and obligations under these Terms, in whole or in part, without notice to you, in connection with a merger, acquisition, sale of assets, reorganization, or by operation of law.

    14.6 No Third-Party Beneficiaries. These Terms do not and are not intended to confer any rights or remedies upon any person or entity other than you and Animaat.

    14.7 Username Management. We reserve the right to refuse, reclaim, or change a username, handle, or similar identifier if we determine, in our sole discretion, that it is appropriate or necessary. This includes, but is not limited to, instances of impersonation, infringement of intellectual property rights, or where a username is misleading, offensive, or unrelated to your identity.

    14.8 Third-Party Links and Services. The Platform may contain links to third-party websites, services, or resources that are not owned or controlled by Animaat. We provide these links for convenience only. We do not endorse, monitor, or assume any responsibility for their content, privacy policies, or practices. Your interactions with such third parties are solely between you and them, at your own risk.

    14.9 Feedback. You acknowledge that any feedback, comments, or suggestions you provide regarding Animaat or the Services (“Feedback”) is given voluntarily. Animaat may use such Feedback for any purpose without obligation of any kind, including without limitation to improve or modify its Services. Such Feedback is non-confidential and shall become the sole property of Animaat.

    14.10 Reservation of Rights. All rights not expressly granted to you under these Terms are reserved by Animaat and its licensors. No license or right is granted hereunder, by implication, estoppel, or otherwise.
